Terms & Conditions

A: Definition

"Customer" means any person whomsoever who books a performer online, over the telephone or through the post and engages iMusic to supply said performers and shall include any officer, employee or agent of the Customer as the case may be.

“Force Majeure” means any, act of God, strike, lock out, war, act of terrorism, flood, lightening, fire, explosion, earthquake, civil commotion, riot or any unforeseeable act that may prevent the natural progression of events.

"service providers" means any service or product supplier in partnership with iMusic.

"Services" means the supply to Customers by iMusic of disc jockey's, solo acts and bands, either individually or in any combination.

"these Terms" mean these terms and conditions.

The clause headings are inserted for ease of reference only and shall not affect the interpretation or construction of these Terms.

B: Scope Of These Terms And Form Of Agreement

1.   These Conditions shall supersede all earlier conditions of iMusic.

2.   These conditions shall take precedence over any conditions of the Customer and shall not be varied without the written consent of iMusic.

3.    iMusic may change these Terms from time to time without notice to the Customer. Changes will apply to any subsequent bookings received.

C: Booking

1.    Upon receiving an enquiry, a quotation may be sent to your e-mail address in addition to a written quotation sent through the post.

2.    All mail is either sent the same day when received before 16:30, or the following day thereafter.

3.    When making an enquiry, a provisional booking will be made on your behalf in order to hold the date.

4.    All bookings require a non-refundable deposit of 30% to be received in addition to a signed & dated Sales Contract within 14 days of the quotation date. Cheques should be made payable to iMusic & sent to:

                  iMusic, 30 Mornington Road, Ilkley, Leeds, West Yorkshire, LS29 8JA.

5.    All bookings are only confirmed once the deposit has been received and has been cleared, and a signed and dated Sales Contract is received by us. A letter of confirmation is sent out once this has been completed.

6.    All completed bookings must be paid in full no later than 7 days prior to the event date. Failure to do so will be a breach of these Terms and will therefore invalidate the booking, resulting in no entertainment being provided.

7.     Please refer to Clause D for further information on cancellations.

D: Cancellation

1.    All cancellations of completed bookings attract a cancellation fee of 30% of the quoted price.

2.    Cancellations made within 5 working days of the event are subject to a 50% cancellation fee of the quoted price.

3.    Cancellations made within 24 hours of an event are subject to the equivalent of 100% of the quoted price.

4.    Should you wish to cancel a completed booking, please return a copy of the Sales Contract, deleting as appropriate, to iMusic to the above address. Once received, all monies less the cancellation fee are returned along with a confirmation letter and receipt by return of post.

E: Onsite Safety

Prior to an event, every precaution will be made to ensure the comfort and safety of your guests is maintained. All cables are routed away from public access however, where this is not possible, security tape is used in order to prevent any possibility of tripping. The speakers and feature lights are mounted on sturdy “telescopic tripod” stands to a height sufficient to clear most people.

F: Payment

1.  All prices quoted by iMusic to the Customer are in pounds sterling and are exempt from Value Added Tax.

2.   iMusic accepts, as a method of payment the following:- Cash, Cheque, Bankers Draft & Direct Bank Transfer.

3.  Save as agreed between iMusic and the Customer, the Customer will pay all sums dueu under these Terms in full prior to the event.

4.  Prices cannot be changed after bookings are confirmed via quotation or once a contract has begun, unless prior arrangements have been agreed between iMusic and the customer.

5.  No deposit shall be taken in lieu of full payment by iMusic.

6.  Prices are subject to change without notice.

7.  Prices stated within a quotation are frozen as such and are not affected by sub-clause  F5.

8.   The Customer’s obligations under the terms of Clause F shall not be satisfied until iMusic is in the receipt of cleared funds.

9.  Unless as part of any scheme or arrangement operated by iMusic, iMusic shall not offer any Customer any discounts.

G: Force Majeure

"Force Majeure” means any, act of God, strike, lock out, war, act of terrorism, flood, lightening, fire, explosion, earthquake, civil commotion or riot or any reasonably unforeseeable act that may prevent the natural progression of events.

If the performance of iMusic's obligations are delayed or hindered by Force Majeure the following provisions shall apply:-

1.    iMusic will as soon as reasonably practicable give the Customer notice of the reasons for the delay or hindrance. However, failure to give such notice will not prevent iMusic relying on the remaining provisions of this clause, and iMusic will incur no liability for failure to give such notice.

2.    iMusic‘s duty to provide the service(s) shall be suspended for as long as the circumstances amounting to Force Majeure continue, and the time for performance of iMusic's obligations shall be extended by a period equal to the duration of those circumstances.

H: Liabilities

Any or all statements, recommendations, advice and opinions made or expressed, including any statements referred to or contained, in any iMusic website, email correspondence, brochures, catalogues, correspondence and the like are made or expressed in good faith and on the basis of information available to iMusic at the time. No statement, recommendation, advice or opinion or any other communication whatsoever is deemed to be a representation, undertaking, warranty, guarantee or contractual obligation on the part of iMusic.

Any and all bookings made from our options list, are made in good faith and are subject to the information given at the time. Customers understand that our service providers' offer these services in partnership with iMusic and that our service providers current terms are in effect at all times. The customer shall be bound by these terms for the duration of the event once a booking is made. This may include liability to the customer for any damage caused to equipment used. Customers are advised to verify such terms prior to making a booking.

iMusic will not be held liable to compensate the Customer for any loss of anticipated profits, damage to the customer’s reputation or goodwill, loss of expected future business or any damages, costs or expenses incurred by these third parties who are not customers. In addition, iMusic shall not be held liable to the Customer in respect of any losses suffered by the Customer where such losses were not reasonably foreseeable to both iMusic and the Customer when the Contract was made. iMusic shall not be liable for any losses incurred by the Customer nor shall iMusic be held responsible for any detrimental effect caused by said service providers unless such loss was caused by any breach of these Terms or otherwise on the part of iMusic.

I: Complaints

 

1.    All complaints received by iMusic shall be acknowledged within five working days and iMusic shall at the point of acknowledgement provide to the Customer a reasonable estimate of the timescale involved in handling and resolving any such complaint. iMusic shall keep the Customer informed as to the progress of the complaint.

2.    In the unlikely event that iMusic fails to fulfil its obligation set out in these terms, the customer should contact iMusic detailing their grievances in writing.

3.    Should the customer feel any grievance against a specialised DJ, solo act or band booked through iMusic, a letter detailing such grievances should be sent to the stated address.

4.    Where sub-clauses I2 and/or I3 apply, correspondence should be sent to:

J: Privacy Policy

All information held on our system is password protected and will never be sold to third party companies. Personal information is information that identifies you as an individual, rather than as a member of a group. Please take a moment to read iMusic’s policy to understand the choices you have and the way that we collect and use information.
 
Please note that this policy only applies to iMusic’s website and the services we offer and not to the website of other companies, individuals or organisations to which we provide links.
 
iMusic collect information about you for 2 reasons: firstly, to process your booking and secondly, to help maintain our standards of service and to allow you, the customer, to make the most of these services. We will not take personally identifying information from you without your prior consent.

We will never sell, lease or otherwise trade in personal information collected at our site to third parties. A third party includes those sites that are linked to our website. iMusic is committed to protecting your privacy. We will only use the information that we collect about you lawfully in accordance with the Data Protection Acts of 1984 and 1998. You may request a copy of all the information that iMusic hold about you by contacting us in writing. If you find any inaccuracies iMusic will correct it promptly.

iMusic protects personal information by putting in place appropriate physical, electronic and managerial procedures to safeguard and secure the personal information we collect from you. This prevents unauthorised access, maintains data security and accuracy and ensures that the personal information is used correctly. We use a secure server that encrypts all the personal information that you input before it is sent to us.

The type of information iMusic will collect about you includes:

• your name

• address

• phone number

• email address

You can visit iMusicuk.com without telling us about yourself and without disclosing any personal information. If you choose to provide us with such information, it will be collected, stored and used in accordance with this policy. iMusic may use technology to track the patterns of behaviour of visitors to our site. This can include using a “cookie” which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings.

We may confirm this information with your chosen venue in order to liaise directly with them and to help prevent potential problems on the night. We will not share any of the personal information listed above with outside parties except to the extent necessary to fulfil your booking.

Save to the process of the completion of your booking, iMusic will not email you in the future unless you have given us your prior consent. iMusic will give you the chance to refuse any marketing communication by way of an opt-out opportunity on the Sales Contract provided with the quotation, however if you prefer, notification of intent can be made earlier.

In such cases where consent is given, from time to time, promotional or follow-up literature may be made available to you by letter, e-mail, and telephone or otherwise as part of any marketing campaign employed by iMusic at the time.

When you enter a competition or other promotional feature, we will take your name, address and e-mail address so that we may administer the contest and notify you if you have won. We will not share this personal information with outside parties except to the extent necessary to administer the contest and notify you if you have won.
